These Terms & Conditions (“Terms”) form a binding agreement between you (“user,” “you,” or “client”) and Finnotech Systems (“we,” “our,” or “us”), governing your use of https://finnotechsystems.com/ and any related services.

By accessing our website, engaging our services, or communicating with us — including via WhatsApp — you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our services.

Finnotech Systems provides technology-driven business and marketing solutions, including but not limited to:

• Website development and design
• Digital marketing and paid advertising campaigns
• Search engine optimization (SEO)
• Social media marketing
• AI-driven video production
• WhatsApp Business API integration and customer communication

We reserve the right to modify, suspend, or discontinue any part of our services at any time, with or without notice.

You must be at least 18 years old and have the legal capacity to enter into a binding contract to use our services. If you register an account or submit information on behalf of a business, you confirm you are authorized to act for that business.

You are responsible for maintaining the confidentiality of any account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use.

When using our website or services, you agree not to:

• Violate any applicable law, regulation, or third-party right
• Transmit spam, malware, or unsolicited bulk messages through our systems
• Attempt to gain unauthorized access to our systems, accounts, or data
• Reverse-engineer, scrape, or misuse any part of our website or software
• Use our WhatsApp Business API access to send messages to recipients who have not opted in
• Impersonate any person or misrepresent your affiliation with any entity

Fees for our services are as agreed in your service proposal, invoice, or contract with us. Unless otherwise stated:

• Invoices are due upon receipt or per the agreed payment schedule
• Late payments may result in suspension of services
• All fees are exclusive of applicable taxes unless stated otherwise
• Refunds, where applicable, are handled on a case-by-case basis per the terms of your service agreement

All content on our website — including text, graphics, logos, and software — is the property of Finnotech Systems or its licensors and is protected by applicable intellectual property laws.

Deliverables created for a client under a paid engagement are licensed or transferred to that client per the terms of the specific service agreement. Absent a written agreement stating otherwise, Finnotech Systems retains ownership of underlying tools, templates, and frameworks used to deliver the work.

Where we communicate with you via the WhatsApp Business API (provided by Meta Platforms, Inc.), such messaging is also governed by WhatsApp’s Business Terms of Service and Meta’s platform policies.

You may opt out of WhatsApp communications at any time as described in our Privacy Policy. We are not responsible for message delivery failures, outages, or changes to WhatsApp/Meta’s platform that are outside our control.

Our website and services may link to or integrate with third-party platforms (e.g., Meta/WhatsApp, Google, payment processors, hosting providers). We do not control and are not responsible for the content, policies, or practices of those third parties.

Our website and services are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that our services will be uninterrupted, error-free, or achieve any specific business result (e.g., marketing or advertising outcomes).

To the maximum extent permitted by law, Finnotech Systems shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from your use of our website or services. Our total aggregate liability for any claim shall not exceed the amount you paid us for the specific service giving rise to the claim in the preceding 12 months.

You agree to indemnify and hold Finnotech Systems, its employees, and affiliates harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your breach of these Terms, misuse of our services, or violation of any applicable law or third-party right.

We may suspend or terminate your access to our website or services at any time, with or without cause or notice, including for suspected violation of these Terms. You may stop using our services at any time; any outstanding fees for services already rendered remain payable.

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Any dispute arising from these Terms or our services shall first be attempted to be resolved through good-faith negotiation, and failing that, shall be subject to the exclusive jurisdiction of the courts of India.

We may update these Terms from time to time. When we do, we will revise the “Last Updated” date at the top of this page. Continued use of our website or services after changes take effect constitutes acceptance of the revised Terms.
